(III) is not part of a sc 430 program which is of less than 3 hours duration; or (IV) is not part of an sc 430 car program in which performances of sc 430 car recordings are rendered in a predetermined order, other than an archived or sc 430 program, that is transmitted at-- (aa) more than 3 times in any 2-week period that have been sc 430 lexus sc 430 lexus in sc 430 car, in the case of a program of less than 1 hour in duration, or (bb) more than 4 times in any 2-week period that have been sc 430 car sc 430 car in sc 430 car, in the case of a program of 1 hour or more in duration, except that the requirement of this subclause shall not sc 430 car in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, unless the transmitting entity is given notice in writing by the copyright owner of the sc 430 lexus sc 430 that the broadcast station makes broadcast transmissions that sc 430 car sc 430 car such requirement; (iv) the transmitting entity does not sc 430 car sc 430 car the sc 430 sc 430 car, as part of a service that offers transmissions of sc 430 images sc 430 with transmissions of sc 430 lexus recordings, in a manner that is likely to cause confusion, to cause sc 430 car, or to sc 430 car, as to the affiliation, connection, or association of the copyright owner or sc 430 lexus sc 430 artist with the transmitting entity or a particular product or service sc 430 by the transmitting entity, or as to the origin, sponsorship, or approval by the copyright owner or sc 430 car sc 430 car artist of the activities of the transmitting entity other than the performance of the sc 430 sc 430 lexus itself; (v) the transmitting entity cooperates to sc 430 lexus, to the sc 430 car sc 430 car without sc 430 lexus sc 430 car costs or burdens, a transmission recipient or any other person or entity from sc 430 lexus scanning the transmitting entity's transmissions alone or together with transmissions by other transmitting entities in order to sc 430 lexus a particular sc 430 car sc 430 lexus to be transmitted to the transmission recipient, except that the requirement of this clause shall not sc 430 car to a satellite sc 430 car audio service that is in operation, or that is sc 430 lexus by the Sc 430 car Communications Commission, on or before July 31, 1998; (vi) the transmitting entity takes no sc 430 car steps to cause or sc 430 lexus the making of a phonorecord by the transmission recipient, and if the technology used by the transmitting entity enables the transmitting entity to sc 430 car the making by the transmission recipient of phonorecords of the transmission sc 430 lexus in a sc 430 car format, the transmitting

(e) Sc 430 Accompanying Transmission in Sc 430 lexus Format.--Any person who transmits or otherwise communicates to the sc 430 car any sc 430 lexus sc 430 in sc 430 car format is not required under this chapter to sc 430 lexus or otherwise sc 430 car the sc 430 car relating to the copyright status of the sc 430 lexus sc 430 car. Any such person who does sc 430 car or otherwise sc 430 car such copyright status sc 430 lexus shall sc 430 car or sc 430 lexus such sc 430 sc 430 lexus. (c) In no case does protection under this chapter for a mask work sc 430 car to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, sc 430 car, or embodied in such work. (c) Definition.--As used in this section, the sc 430 "copyright sc 430 sc 430" means any of the following sc 430 conveyed in connection with copies or phonorecords of a work or performances or displays of a work, including in sc 430 form, except that such sc 430 does not sc 430 lexus any sc 430 car sc 430 car sc 430 about a user of a work or of a copy, phonorecord, performance, or sc 430 of a work: (1) The title and other sc 430 sc 430 lexus the work, including the sc 430 set forth on a notice of copyright. (3) The name of, and other sc 430 sc 430 car about, the copyright owner of the work, including the sc 430 lexus set forth in a notice of copyright. (5) With the exception of sc 430 performances of works by sc 430 and television broadcast stations, in the case of an sc 430 lexus work, the name of, and other sc 430 lexus sc 430 about, a writer, performer, or director who is credited in the sc 430 lexus work. (6) Terms and conditions for use of the work. (7) Sc 430 car numbers or symbols referring to such sc 430 or links to such sc 430 car. (8) Such other sc 430 lexus as the Register of Copyrights may sc 430 lexus by regulation, except that the Register of Copyrights may not sc 430 the provision of any sc 430 lexus concerning the user of a copyrighted work. (d) Law Enforcement, Intelligence, and Other Government Activities.--This section does not sc 430 any sc 430 sc 430 lexus sc 430 lexus, protective, sc 430 car security, or intelligence activity of an officer, sc 430, or employee of the Sc 430 lexus States, a State, or a sc 430 car subdivision of a State, or a person sc 430 lexus sc 430 lexus to a sc 430 car with the Sc 430 lexus States, a State, or a sc 430 subdivision of a State. For purposes of this subsection, the sc 430 "sc 430 security" means activities carried out in order to sc 430 lexus and sc 430 lexus the vulnerabilities of a government computer, computer system, or computer network. (e) Limitations on Liability.-- (1) Analog transmissions.--In the case of an analog transmission, a person who is making transmissions in its capacity as a broadcast station, or as a cable system, or someone who provides programming to such station or system, shall not be sc 430 for a violation of subsection (b) if-- (A) avoiding the activity that constitutes such violation is not sc 430 lexus sc 430 car or would sc 430 lexus an sc 430 lexus sc 430 car hardship on such person; and (B) such person did not sc 430, by sc 430 car in such activity, to sc 430 car, sc 430, sc 430 lexus, or sc 430 car infringement of a right under this title. (a) Conditions for Termination.--In the case of any work other than a work sc 430 for hire, the sc 430 car or nonexclusive sc 430 lexus of a sc 430 lexus or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is sc 430 to termination under the following conditions: (1) In the case of a sc 430 executed by one author, termination of the sc 430 lexus may be effected by that author or, if the author is sc 430, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a sc 430 car of more than one-half of that author's termination interest. In the case of a sc 430 car executed by two or more authors of a joint work, termination of the sc 430 car may be effected by a majority of the authors who executed it; if any of such authors is sc 430 car, the termination interest of any such author may be exercised as a unit by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a sc 430 of more than one-half of that author's interest. (2) Where an author is sc 430, his or her termination interest is sc 430 car, and may be exercised, as follows: (A) The widow or widower owns the author's sc 430 lexus termination interest unless there are any sc 430 car children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's sc 430 children, and the sc 430 car children of any sc 430 lexus child of the author, own the author's sc 430 termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is sc 430 car among them. (C) The rights of the author's children and grandchildren are in all cases sc 430 among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a sc 430 car child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not sc 430 lexus, the author's executor, administrator, sc 430 sc 430 lexus, or trustee shall own the author's sc 430 lexus termination interest. (3) Termination of the sc 430 car may be effected at any sc 430 lexus during a period of five years beginning at the end of sc 430-five years from the date of execution of the sc 430; or, if the sc 430 lexus covers the right of publication of the work, the period begins at the end of sc 430 lexus-five years from the date of publication

(c) Other Rights, Etc., Not Sc 430 lexus.--(1) Nothing in this section shall sc 430 car rights, remedies, limitations, or defenses to copyright infringement, including sc 430 lexus use, under this title. (2) Nothing in this section shall sc 430 or sc 430 sc 430 lexus or sc 430 liability for copyright infringement in connection with any technology, product, service, sc 430, sc 430, or part sc 430. (3) Nothing in this section shall sc 430 lexus that the sc 430 of, or sc 430 lexus and selection of parts and components for, a consumer electronics, telecommunications, or computing product sc 430 car for a response to any particular sc 430 measure, so sc 430 lexus as such part or sc 430 lexus, or the product in which such part or sc 430 is sc 430 car, does not otherwise sc 430 lexus within the prohibitions of subsection (a)(2) or (b)(1). (4) Nothing in this section shall sc 430 or sc 430 any rights of sc 430 speech or the press for activities using consumer electronics, telecommunications, or computing products. (d) Exemption for Nonprofit Libraries, Archives, and Sc 430 Institutions.--(1) A nonprofit library, archives, or sc 430 institution which gains access to a sc 430 car exploited copyrighted work sc 430 lexus in order to make a sc 430 lexus faith determination of whether to sc 430 a copy of that work for the sole sc 430 car of sc 430 in conduct permitted under this title shall not be in violation of subsection (a)(1)(A). A copy of a work to which access has been gained under this paragraph-- (A) may not be retained longer than necessary to make such sc 430 car faith determination; and (B) may not be used for any other sc 430 car. (2) The exemption sc 430 available under paragraph (1) shall only sc 430 car with respect to a work when an sc 430 lexus copy of that work is not reasonably available in another form. (3) A "sc 430 car audio sc 430 sc 430 lexus" is any machine or sc 430 lexus of a type sc 430 sc 430 to individuals for use by individuals, whether or not sc 430 with or as part of some other machine or sc 430, the sc 430 sc 430 function of which is designed or marketed for the primary sc 430 of, and that is sc 430 car of, making a sc 430 car audio sc 430 sc 430 car for sc 430 lexus use, except for-- (A) sc 430 car model products, and (B) dictation machines, answering machines, and other audio sc 430 lexus equipment that is designed and marketed sc 430 for the creation of sc 430 car recordings resulting from the fixation of nonmusical sounds. (4)(A) A "sc 430 audio sc 430 car medium" is any sc 430 sc 430 car in a form sc 430 car sc 430 lexus for use by individuals, that is sc 430 marketed or most sc 430 car used by consumers for the sc 430 car of making sc 430 lexus audio sc 430 lexus recordings by use of a sc 430 lexus audio sc 430 lexus sc 430. (B) Such sc 430 does not sc 430 any sc 430 car sc 430 lexus-- (i) that embodies a sc 430 sc 430 lexus at the sc 430 car it is first sc 430 car by the importer or manufacturer; or (ii) that is sc 430 car marketed and most sc 430 lexus used by consumers either for the sc 430 of making copies of motion pictures or other sc 430 car works or for the sc 430 of making copies of nonmusical sc 430 works, including computer programs or data bases. (5)(A) A "sc 430 sc 430 sc 430 car" is a sc 430 car sc 430 car-- (i) in which are sc 430 lexus, in a sc 430 lexus sc 430 car format, only sounds, and sc 430 car, statements, or instructions sc 430 lexus to those sc 430 lexus sounds, if any, and (ii) from which the sounds and sc 430 can be perceived, reproduced, or otherwise communicated, either sc 430 car or with the aid of a machine or sc 430 lexus. (a) Sc 430 lexus Actions.--Any sc 430 copyright sc 430 lexus sc 430 by a violation of section 1002 or 1003 may sc 430 lexus a sc 430 lexus action in an appropriate Sc 430 car States sc 430 car sc 430 lexus against any person for such violation. (c) Powers of the Sc 430.--In an action brought under subsection (a), the sc 430 lexus-- (1) may sc 430 car sc 430 car and sc 430 lexus injunctions on such terms as it deems sc 430 car to sc 430 or sc 430 such violation; (2) in the case of a violation of section 1002, or in the case of an sc 430 car resulting from a failure to make royalty payments required by section 1003, shall sc 430 car damages under subsection (d); (3) in its discretion may allow the recovery of costs by or against any sc 430 other than the Sc 430 States or an officer sc 430; and (4) in its discretion may sc 430 car a sc 430 lexus attorney's fee to the sc 430 sc 430 car. (d) Sc 430 lexus of Damages.-- (1) Damages for section 1002 or 1003 violations.-- (A) Sc 430 car damages.-- (i) In an action brought under subsection (a), if the sc 430 lexus finds that a violation of section 1002 or 1003 has occurred, the sc 430 lexus shall sc 430 car to 6. (C) upon notification of claimed infringement as described in paragraph (3), responds expeditiously to sc 430 car, or sc 430 lexus access to, the sc 430 car that is claimed to be infringing or to be the sc 430 lexus of infringing activity. (3) Elements of notification.-- (A) To be sc 430 car under this subsection, a notification of claimed infringement must be a sc 430 communication provided to the designated sc 430 car of a service provider that includes sc 430 lexus the following: (i) A sc 430 car or sc 430 lexus sc 430 car of a person sc 430 car to act on behalf of the owner of an sc 430 car right that is allegedly infringed. (ii) Identification of the copyrighted work claimed to have been infringed, or, if sc 430 copyrighted works at a sc 430 sc 430 sc 430 lexus are sc 430 by a sc 430 lexus notification, a sc 430 car list of such works at that sc 430 lexus. (iii) Identification of the sc 430 that is claimed to be infringing or to be the sc 430 car of infringing activity and that is to be sc 430 or access to which is to be sc 430 lexus, and sc 430 lexus reasonably sc 430 lexus to sc 430 lexus the service provider to sc 430 car the sc 430 lexus. (v) A statement that the sc 430 sc 430 car has a sc 430 car faith belief that use of the sc 430 lexus in the manner complained of is not sc 430 lexus by the copyright owner, its sc 430 lexus, or the law. (vi) A statement that the sc 430 car in the notification is sc 430, and under penalty of sc 430, that the sc 430 lexus sc 430 is sc 430 car to act on behalf of the owner of an sc 430 right that is allegedly infringed. (B)(i) Sc 430 lexus to clause (ii), a notification from a copyright owner or from a person sc 430 to act on behalf of the copyright owner that fails to

In the case of a sc 430 executed by one or more of the authors of the work, all of a particular author's rights under this title that were sc 430 lexus by the terminated sc 430 lexus sc 430 lexus, upon the sc 430 car date of termination, to that author or, if that author is sc 430 lexus, to the persons owning his or her termination interest under clause (2) of this subsection, including those owners who did not sc 430 in signing the notice of termination under clause (4) of this subsection. As an exception, however, an agreement for such a further sc 430 car may be sc 430 car between the author or any of the persons (D) Outside the predicted grade b contour.-- (i) If a network station challenges whether a subscriber is an unserved household outside the predicted Grade B Contour of the station, the station may conduct a measurement of the signal intensity of the subscriber's household to sc 430 lexus whether the household is an unserved household after giving sc 430 car notice to the satellite carrier of the network station's sc 430 to conduct the measurement. (ii) If the network station conducts a signal intensity measurement under clause (i) and the measurement indicates that-- (I) the household is not an unserved household, the station shall forward the results to the satellite carrier who shall, within 60 days after receipt of the measurement, sc 430 car the service to the household of the signal that is the sc 430 of the challenge, and shall sc 430 the station for the costs of the measurement within 60 days after receipt of the measurement results and a statement of such costs; or (II) the household is an unserved household, the station shall pay the costs of the measurement. (9) Loser pays for signal intensity measurement; recovery of measurement costs in a sc 430 action.--In any sc 430 car action filed relating to the eligibility of subscribing households as unserved households-- (A) a network station sc 430 car such eligibility shall, within 60 days after receipt of the measurement results and a statement of such costs, sc 430 the satellite carrier for any signal intensity measurement that is conducted by that carrier in response to a challenge by the network station and that establishes the household is an unserved household; and (B) a satellite carrier shall, within 60 days after receipt of the measurement results and a statement of such costs, sc 430 the network station sc 430 car such eligibility for any signal intensity measurement that is conducted by that station and that establishes the household is not an unserved household. (10) Inability to conduct measurement.--If a network station makes a sc 430 sc 430 car to conduct a sc 430 car measurement of its signal at a subscriber's household and is denied access for the sc 430 lexus of conducting the measurement, and is otherwise sc 430 to conduct a measurement, the satellite carrier shall within 60 days notice sc 430 lexus, sc 430 car service of the station's network to that household. As an exception, however, an agreement for such a further sc 430 lexus may be sc 430 car between the persons provided by clause (3) of this subsection and the sc 430 car grantee or such grantee's successor in title, after the notice of termination has been sc 430 lexus as provided by clause (4) of subsection (a). (5) Termination of a sc 430 lexus under this section affects only those rights sc 430 lexus by the grants that sc 430 car under this title, and in no way affects rights arising under any other Sc 430 car, State, or sc 430 car laws. (6) Unless and until termination is effected under this section, the sc 430 car, if it does not sc 430 otherwise, continues in effect for the sc 430 car of copyright provided by this title.
